Terms of Service

NOTICE: These Terms include a mandatory arbitration provision (Section 19) that requires individual arbitration for disputes seeking monetary relief in certain circumstances, rather than jury trials or class actions.
1. Description of the Service
GreetEmma provides AI-powered voice agent services for front-door automation and appointment booking. The Service enables businesses to automate their reception and customer service functions through intelligent voice interactions. Our platform includes:
- 24/7 AI voice agent call handling
- Real-time appointment scheduling and management
- Google Calendar integration for seamless booking
- Voice-based customer interaction and support
- Call routing and message taking capabilities
- Business hours and availability management
Voice recordings may be processed and analyzed via third-party AI providers, including Pipecat Cloud, OpenAI, Google, and similar services for conversation analysis, appointment booking, and performance optimization.
GreetEmma may update, change, suspend, or discontinue any aspect of the Service at any time, in its sole discretion, with or without notice.
2. Eligibility
You must be at least 18 years old and have legal capacity to enter into contracts to use the Service. If you are using the Service on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.
You represent that you are not:
- Located in a country subject to U.S. economic sanctions
- Listed on the U.S. Treasury's List of Specially Designated Nationals
- Otherwise restricted from receiving the Service
You must comply with all applicable local, national, and international laws and regulations.
3. Registration and Account Security
To use the Service, you must create an account through our authentication system (Clerk) with Google OAuth integration. You agree to:
- Provide accurate, current, and complete registration information
- Maintain the confidentiality of your credentials and not share them with others
- Promptly update your information if it changes
- Be responsible for all activity under your account
- Notify GreetEmma immediately of unauthorized use of your account
We may suspend or terminate your account for violations of these Terms or at our discretion.
4. Service Functionality and AI Disclaimer
4.1 Voice Agent Features
The Service enables AI-driven voice interactions for business automation, including call handling, appointment scheduling, and customer service. Voice data is processed through third-party AI services (including Pipecat Cloud, OpenAI, Google) for real-time conversation handling and appointment booking.
By using the Service, you consent to such data processing and handling, subject to our Privacy Policy.
4.2 AI and Business Automation Disclaimer
GreetEmma is a business automation tool. The Service is not a substitute for human judgment, professional advice, or critical business decisions. AI-generated responses and appointment scheduling are based on pattern recognition and may be inaccurate, incomplete, or inappropriate for certain situations.
GreetEmma is not liable for errors in AI responses, missed appointments, scheduling conflicts, or any business decisions based on AI analysis. You are solely responsible for:
- Verifying appointment accuracy and availability
- Ensuring compliance with your business policies and legal requirements
- Monitoring AI agent performance and customer interactions
- Handling critical or sensitive customer inquiries appropriately
4.3 Calendar Integration
The Service integrates with Google Calendar through OAuth authentication. You grant GreetEmma permission to access your calendar for appointment scheduling, availability checking, and booking management. You remain responsible for calendar accuracy and appointment management.
5. Subscription Plans and Billing
Access to the Service requires a paid subscription. Available subscription plans include various tiers with different features and usage limits. Details of current pricing and included features are displayed in the application prior to purchase.
5.1 Automatic Renewal
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. To cancel or modify your subscription, use the account settings in the application.
5.2 Payment Processing
Payments are processed through secure third-party payment processors. You agree to provide accurate payment information and authorize charges for your selected subscription plan.
5.3 Refunds
Refunds are handled on a case-by-case basis. Contact support for refund requests. For EU/UK users, your statutory rights under applicable consumer protection laws are not affected.
6. Acceptable Use
You are responsible for your use of the Service and must comply with all applicable laws. You may not:
- Use the Service for unlawful purposes or in violation of any applicable laws or regulations
- Use the Service to generate or distribute content that is defamatory, abusive, threatening, harassing, hateful, discriminatory, or incites violence
- Impersonate others or misrepresent your identity or business
- Use the Service to generate or distribute spam, unsolicited promotional content, or fraudulent communications
- Attempt to reverse-engineer, decompile, or hack the Service or interfere with its normal operation
- Use the Service in a way that harms GreetEmma, other users, or the integrity of the platform
- Violate any third-party rights, including privacy, publicity, or intellectual property rights
7. Third-Party Services and Integrations
The Service integrates with various third-party services, including:
- Google Calendar API for appointment scheduling
- Pipecat Cloud for voice agent hosting and processing
- OpenAI for AI conversation capabilities
- Twilio for telephony services
- Clerk for authentication services
Your data may be shared with these providers only as needed to operate the Service. GreetEmma is not responsible for the operation, terms, or privacy practices of these third-party services. Your use of these services is subject to their respective terms and privacy policies.
8. Intellectual Property
All Service content, including software, designs, text, graphics, and trademarks, is owned by GreetEmma or its licensors and is protected by intellectual property laws. You may not copy, distribute, or reproduce Service content except as permitted for normal use of the Service.
You retain ownership of your business data and customer information. By using the Service, you grant GreetEmma a limited, non-exclusive license to use your data solely for providing and improving the Service.
9. Privacy and Data Protection
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information. The Service complies with applicable data protection laws, including GDPR and CCPA where applicable.
10. Service Availability and Performance
While we strive to provide reliable 24/7 service availability, we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, technical issues, or third-party service outages. We are not liable for any business losses resulting from service interruptions.
11. No Warranties
The Service is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. GreetEmma does not guarantee accuracy of AI responses, appointment scheduling, or error-free operation. Some jurisdictions do not allow certain warranty exclusions, so these limitations may not apply to you.
12. Limitation of Liability
To the maximum extent permitted by law, GreetEmma is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including loss of data, profits, business interruption, or missed appointments. Our total liability is limited to the amount you paid for the Service in the 12 months prior to the claim.
This limitation does not apply where prohibited by applicable consumer protection laws.
13. Indemnification
You agree to indemnify and hold harmless GreetEmma, its officers, employees, and affiliates from any claims, losses, or damages (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of third-party rights.
14. Termination
Either party may terminate your access to the Service at any time. GreetEmma may terminate your account for violations of these Terms or for any reason with reasonable notice. Upon termination, your right to use the Service ceases immediately, and we may delete your account data subject to applicable law and our data retention policies.
15. Consumer Protection Rights
15.1 EU/UK Rights
EU users have rights under Directive 2011/83/EU, including a 14-day right to withdraw from digital services unless you expressly consent to immediate access. UK users have similar rights under the Consumer Rights Act 2015.
15.2 California Residents
California users may contact the Complaint Assistance Unit of the California Department of Consumer Affairs. You have rights under the CCPA, including the right to access, delete, or opt out of the sale of personal information. GreetEmma does not sell personal information.
16. Governing Law and Jurisdiction
These Terms are governed by the laws of the United Arab Emirates, excluding conflict of law provisions. For EU/UK users, mandatory consumer protection laws in your country may also apply. Disputes will be resolved in the courts of the United Arab Emirates, subject to the arbitration provisions below.
17. International Use
The Service is available globally. By using the Service, you agree to comply with all applicable local laws, including data protection regulations (GDPR, CCPA) and consumer rights laws. GreetEmma makes no representation that the Service is appropriate or available in all jurisdictions.
18. Updates to Terms
GreetEmma may update these Terms at any time to reflect changes in our Service, legal requirements, or for other reasons. Updated versions will be posted with at least 7 days notice before taking effect, unless required sooner by law. For material changes, we may provide additional notice via email or in-app alert. Continued use after the effective date constitutes acceptance of updated Terms.
19. Dispute Resolution and Arbitration
For disputes seeking monetary relief, you agree to resolve claims through binding individual arbitration:
19.1 Notice
The claimant must send written Notice of Claim to legal@greetemma.com, including name, contact details, claim basis, and relief sought.
19.2 Settlement Conference
Within 30 days, parties must hold a good-faith settlement conference via phone or video.
19.3 Arbitration Process
If no settlement is reached, arbitration will be conducted under applicable arbitration rules in the United Arab Emirates. Small claims court jurisdiction is preserved. No class or collective arbitration is permitted.
19.4 Opt-Out
You may opt out of arbitration by emailing legal@greetemma.com within 30 days of first using the Service.
20. Miscellaneous
These Terms, together with the Privacy Policy, constitute the entire agreement between you and GreetEmma. If any provision is found invalid, the remaining provisions remain in effect. GreetEmma may assign these Terms without consent. You may not assign without our written consent.
Nothing in these Terms affects your statutory consumer rights. GreetEmma is not liable for failure to perform due to events beyond its control, including natural disasters, cyberattacks, or government actions.
